The U.S. Department of Education has published the proposed distance education regulations in the official Federal Register, allowing stakeholders the opportunity to comment on the proposed language on or before May 4, 2020 (30 days from the publish date).
The proposed language was largely drafted by a subcommittee of distance education stakeholders, including many from the CBE community, and voted upon unanimously by the full committee. Because the committee reached consensus, The Department has to publish the consensus language agreed upon by the full committee, but they do not have to stick with this language for the final rule. The next step is the 30-day comment period, where stakeholders can make comments on the proposed rule. The Department will take the comments (and its own thinking) and come up with a final rule.
